1. Acceptance of Terms

DualCam is a mobile application that allows users to capture and manage photos and videos using advanced dual camera features. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and Mobixoft LLC ("we", "us", or "our") governing your use of the DualCam mobile application ("App"). By accessing or using the App, you confirm that you are at least 13 years of age and agree to be bound by these Terms.

2. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple-branded device you own or control, solely for your personal, non-commercial purposes.

You may not:

• Copy, modify, or distribute the App or any part of it
• Reverse engineer, decompile, or attempt to extract the source code
• Rent, lease, sell, or sublicense the App
• Use the App for any unlawful purpose or in violation of any applicable law
• Remove or alter any proprietary notices or labels on the App

3. Subscriptions and In-App Purchases

DualCam offers optional paid subscriptions ("DualCam Pro") that unlock additional features. Subscriptions are offered on a weekly, monthly, yearly, or lifetime basis.

• Billing: Subscriptions are billed through your Apple ID account. Payment is charged upon confirmation of purchase.
• Auto-Renewal: Recurring subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Cancellation: You may cancel at any time via your Apple ID account settings. Cancellation takes effect at the end of the current billing period.
• Refunds: Refund requests are handled by Apple in accordance with their policies. We have no control over refund decisions.
• Price Changes: We reserve the right to change subscription prices. You will be notified in advance of any price changes applicable to your subscription.

4. User Content

All videos and photos you create with DualCam ("User Content") are stored locally on your device and remain entirely yours. We claim no ownership over your User Content.

You are solely responsible for ensuring that any content you create and share complies with applicable laws and does not infringe the rights of any third party, including copyright, privacy, and publicity rights.

5. YouTube and Third-Party Services

DualCam includes optional integration with YouTube and other third-party services. Users can sign in with Google to securely sync their media across devices. Your use of these services is governed by their respective terms:

We are not responsible for the availability, content, or practices of any third-party services.

6. Intellectual Property

The App, including its design, graphics, code, and all associated intellectual property, is owned by Mobixoft LLC and protected by applicable intellectual property laws. Nothing in these Terms grants you any rights in the App beyond the limited license described above.

The DualCam name and logo are trademarks of Mobixoft LLC. You may not use them without our prior written permission.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOBIXOFT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR LOSS OF PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Mobixoft LLC and its officers, directors, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your User Content, or your violation of these Terms or any applicable law.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Updates and Changes

We may update the App from time to time to add features, fix bugs, or comply with new requirements. We reserve the right to modify or discontinue the App at any time without prior notice. We may also update these Terms. Continued use of the App following any changes constitutes your acceptance of the revised Terms.

12. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or if required by law. Upon termination, all licenses granted under these Terms immediately expire.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which Mobixoft LLC is established, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

14. Apple App Store Terms

The App is distributed through the Apple App Store. The following terms apply with respect to Apple:

• These Terms are between you and Mobixoft LLC only, not Apple Inc. Apple has no obligation to provide maintenance or support for the App.
• Apple has no responsibility for addressing any claims relating to the App or your possession and/or use of the App.
• In the event of any third-party claim that the App infringes intellectual property rights, Apple is not responsible for the investigation, defense, settlement, or discharge of such claim.
• Apple is a third-party beneficiary of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
